昨天加州的最高法院法院基於憲法裡有關人民的基本權力部分，決定裁定同性結婚是有法律效應的，而在六位法官中有四位贊成這個論點，在以相對保守的共和黨所提名的五位法官為基礎下能夠做出這樣子的決定實在是有點出乎一般人的意料，其中一位反對的法官認為這個議題應該訴諸於投票來解決這個爭端，因此CNN 360的主持人Anderson Cooper 也對支持同志運動不遺餘力的舊金山市市長Gavin Newsom提出疑問…在2000年加州也曾經對此投票，大部分的加州民眾對於同志結婚是採反對的立場，如今法官的決定是不是違反了大多數的民意，而Gavin Newsom是這麼說的
“I mean, the whole idea of subjecting the minority to the whim of the majority is why we have a Constitution. And that’s to protect the minority. The fact is, it was in 1948 when the California Supreme Court did the right thing and stood on principle against the will of 90 percent of Americans at the time as it related to the ban on interracial marriage.”
對於民意的展現與正義的堅持往往是不能兼得的。
